PREAMBLE 

 These General Terms and Conditions of Sale (hereinafter referred to as "GTC") exclusively govern all contractual relationships between the service Provider and any natural or legal person (hereinafter referred to as "the Client") making a purchase or subscribing to digital access on this platform. By checking the mandatory acceptance box before finalizing their order and proceeding with the payment of their transaction, the Client expressly acknowledges having read these GTC, understands them, and accepts them without reservation, restriction, or condition. The Client acknowledges that they have the legal capacity required to contract and validly commit under these terms.

These GTC constitute the law of the parties and prevail over any other document, correspondence, or contradictory purchase condition. They are enforceable against the Client upon their electronic validation and govern instant access to the infrastructures, software, and digital content provided by the Provider. The Provider reserves the right to unilaterally modify these GTC at any time to adapt them to technical or regulatory developments. The version applicable to the transaction is the one in effect on the platform at the date of validation of the order by the Client.

Article 1 : Purpose and scope of digital services

These General Terms and Conditions of Sale aim to define the legal framework applicable to the provision, distribution and operation of the exclusive digital services and content offered by the Provider. They apply automatically to any remote access, subscription, SaaS service or intangible download made on the platform. This document governs the entire contractual cycle, from the order registration to the termination of the user's access rights. By validating their purchase, the Client confirms exclusive adherence to these technical compliance rules, formally rejecting any contradictory clause not validated in writing by our management.

Article 2 : Ordering process and client account validation

The validation of an order requires the prior creation of a personal user account, requiring the entry of exact and verifiable identification data. The contractual process is deemed perfect as soon as the Client validates their cart, checks the acceptance of the T&Cs, and confirms their intention to pay. Our software infrastructure then conducts an immediate security audit to authenticate the identifiers and the connection IP address. The Provider reserves the sovereign right to freeze or cancel any transaction originating from a suspicious account, presenting a high fraud profile or showing a history of unresolved disputes.

Article 3: Pricing, payment terms, and secure transactions via PayPal

The rates for our digital services are fixed, expressed in legal currencies and payable in full upon validation of the order. Payments are made exclusively through the secure payment infrastructure of our partner PayPal, acting under the strict protocol "Goods and Services." This mechanism ensures end-to-end encryption of financial data and blocks any cyber interception. The Client acknowledges that the final validation of the bank transaction on the PayPal servers serves as irrefutable proof of the transfer of funds and triggers the immediate accounting entry of the invoice within our business records.

Article 4: Terms of electronic delivery and instant activation of access

The delivery of digital products is carried out exclusively by electronic means and instantly after the final validation of payment by PayPal servers. Access to services, software infrastructures, or download links is immediately activated within the customer area or sent to the email address provided during registration. The Provider immutably records in its server logs the date, exact time (timestamp), IP address, and Client ID at the first availability or first access click. This technical data is conclusive and legally materializes the perfect receipt of the product.

Article 5: Express waiver of the right of withdrawal for intangible content

In accordance with regulations on the digital economy and consumer law, the Client is expressly informed that the right of withdrawal does not apply to contracts for the supply of digital content not provided on a tangible medium. By validating their order and immediately accessing the services or downloads, the Client accepts the immediate execution of the contract and expressly, knowingly, and irrevocably waives the exercise of any right of withdrawal. No refund will be granted once access is provided or the digital product is downloaded, which the Client acknowledges and accepts without reservation.

Article 6: Intellectual property, licenses for use, and distribution restrictions

The entirety of the software, source codes, texts, architectures, and graphical interfaces available on the platform remains the exclusive property of the Provider or its partners. The purchase of a digital product grants the Client a personal, non-exclusive, temporary or permanent license depending on the subscribed offer, and strictly non-transferable. It is formally prohibited to copy, modify, redistribute, rent, or resell all or part of the provided content. Any subversion of this clause or sharing of access with third parties will result in the immediate revocation of the account without notice or refund, as well as criminal prosecution for counterfeiting.

Article 7: Guarantee of technical compliance, support and availability of servers

The Provider commits to deploying the necessary technical means to ensure the compliance of digital products with their commercial description and to maintain continuous accessibility of its servers. However, the Client acknowledges that digital services may be subject to temporary suspensions for maintenance operations or corrective updates. Technical assistance via email or through a ticketing system is available to the Client to resolve any access anomalies. The Provider's liability is strictly limited to the technical restoration of access, excluding any compensation for loss of business.

 Article 8: Limitation of liability of the provider and force majeure cases

The Provider cannot be held responsible for indirect damages, loss of opportunity, profits, or data resulting from the use of the platform or digital services. The Provider's maximum overall liability, for any reason, is strictly capped at the net amount actually paid by the Client at the time of the contested order. Furthermore, the Provider's liability is completely excluded in the event of force majeure or disruptions beyond its control, such as global internet network outages, failures of third-party hosting servers, or blockages related to partner payment infrastructures.

Article 9: Protection of personal data (GDPR), collection of IP addresses and connection logs

The Provider processes the personal data of the Client in strict compliance with European and international data protection regulations (GDPR). For reasons of authentication and cyber-perimeter security, the infrastructure collects and automatically retains the IP address, browser type, and the connection logs associated with each download or access activation. These technical elements are essential to prove the electronic delivery of services to banking platforms. The Client has the right to access, rectify, and delete their personal data, which can be exercised upon simple written request to technical support.

Article 10: Dispute resolution, applicable law and jurisdiction allocation

The present General Terms and Conditions of Sale are governed, interpreted, and applied in accordance with the laws in force at the registered office of the Supplier. In the event of a dispute regarding the interpretation or execution of the contract, the parties agree to seek an amicable solution before any legal action or filing of an official complaint on payment platforms. Failing an amicable agreement within a period of thirty days, and notwithstanding the plurality of defendants or calls for warranty, exclusive jurisdiction is expressly granted to the competent courts of the registered office of the Supplier to resolve the dispute.
